Overview

1. Agreement and Parties

(a) These Terms and Conditions (the “Terms”) are a legal agreement between you (“the customer”) and Oday Shop Tanzania, registered in Tanzania with offices located at Ilala, Tabata Bima, Dar es Salaam, Tanzania.

(b) “We”, “us”, and “Oday Shop Tanzania” refer to the applicable Oday Shop Tanzania contracting party.

2. Use of Services

(a) The Terms govern your use of the Oday Shop Tanzania Services (as defined below).

(b) By visiting our site and/or purchasing something from us, you engage in our “Service” and agree to be bound by these Terms.

(c) These Terms apply to all users of the site, including without limitation users who are browsers, suppliers, customers, and/or contributors of content.

3. Governing Law and Jurisdiction

(a) The Terms shall be governed by and interpreted in accordance with the laws of the United Republic of Tanzania applicable therein, without regard to principles of conflicts of laws.

(b) The parties irrevocably and unconditionally submit to the exclusive jurisdiction of the courts of Tanzania with respect to any dispute or claim arising out of or in connection with the Terms.

4. Language and Interpretation

(a) The Terms may be available in languages other than English.

(b) To the extent of any inconsistencies or conflicts between these English Terms and Terms available in another language, the most current English version of the Terms will prevail.

5. Severability

(a) If any provision, or portion of the provision, in these Terms is, for any reason, held to be invalid, illegal, or unenforceable in any respect, then such invalidity, illegality, or unenforceability will not affect any other provision (or the unaffected portion of the provision) of the Terms.

(b) The Terms will be construed as if such invalid, illegal, or unenforceable provision, or portion of the provision, had never been contained within the Terms.

6. Acceptance of Terms

(a) Please read these Terms of Service carefully before accessing or using our website/App.

(b) By accessing or using any part of the site, you agree to be bound by these Terms of Service.

(c) If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any services.

(d) If these Terms of Service are considered an offer, acceptance is expressly limited to these Terms of Service.

7. Online Store Terms

(a) By agreeing to these Terms of Service, you represent that you are at least the age of 18, or that you are the age of 18 and over and you have given us your consent to allow any of your minor dependents to use this site.

(b) You may not use our products for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).

(c) You must not transmit any worms or viruses or any code of a destructive nature.

(d) A breach or violation of any of the Terms will result in an immediate termination of your Services.

8. General Conditions

(a) We reserve the right to refuse service to anyone for any reason at any time.

(b) You understand that your content may be transferred unencrypted and involve transmissions over various networks; and changes to conform and adapt to technical requirements of connecting networks or devices.

(c) You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service or any contact on the website through which the service is provided, without express written permission by us.

(d) The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.

9. Accuracy, Completeness, and Timeliness of Information

(a) We are not responsible if information made available on this site is not accurate, complete, or current.

(b) The material on this site is provided for general information only and should not be relied upon or used as the sole basis for making decisions without consulting primary, more accurate, more complete, or more timely sources of information.

(b) These products or services may have limited quantities and are subject to return or exchange.

(c) We have made every effort to display as accurately as possible the colors and images of our products that appear in the store.

(d) We cannot guarantee that your device’s display of any color will be accurate.

(e) We reserve the right, but are not obligated, to limit the sales of our products or Services to any person, geographic region, or jurisdiction.

(f) We may exercise this right on a case-by-case basis.

(g) We reserve the right to limit the quantities of any products or services that we offer.

(h) All descriptions of products or product pricing are subject to change at any time without notice, at the sole discretion of us.

(i) We reserve the right to discontinue any product at any time.

(j) Any offer for any product or service made on this site is void where prohibited.

13. Accuracy of Order Information

(a) We reserve the right to refuse any order you place with us.

(b) We may, in our sole discretion, limit or cancel quantities purchased per person, per household, or per order.

(c) These restrictions may include orders placed by or under the same customer, the same payment method, and/or orders that use the same delivery address.

(d) In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the phone number or email provided at the time the order was made.

(e) We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers, or distributors.

(f) You agree to provide current, complete, and accurate personal and purchase information for all purchases made at our store.

14. Shipping Policy

(a) We pride ourselves on delivering quality, not just quality products but also quality service to each and every one of our customers.

(b) When you decide to buy from us, we make a commitment to you to deliver quality at every moment.

(c) Once you are our customer you are part of the Oday Shop Tanzania family, just like family we like to care for our customers.

(d) Orders typically take 2 hours or 2 business days to process.

(e) Shipping within Dar es Salaam is within 2 working hours, and outside Dar es Salaam (within Tanzania) takes 2 business days.

(f) Customer in Dar es Salaam we offers home delivery and other regions(Outside Dar es salaam) can pick up orders at the nearest bus office in the town center.

(g) Customers outside of Dar es Salaam should receive their products on the same day they are dispatched by Oday Shop Tanzania to avoid any inconvenience.

(h) Currently, Oday Shop Tanzania utilizes multiple transportation offices to ensure efficient delivery of goods from Dar es Salaam to other regions.

(i) Oday Shop Tanzania will provide customers outside of Dar es Salaam with schedules for receiving their products from the respective shipping offices, including the expected delivery day.

(J) For customers outside of Dar es Salaam, if you have not received your product within five (5) days from the expected delivery date communicated by Oday Shop Tanzania, and after notifying all relevant shipping office notifications of receipt, we will not be liable for any challenges that may arise, such as loss or damage.

(k) For customers outside of Dar es Salaam, if five(5) days have passed and you have not received your product, and if the product has been damaged, please contact the service provider at the shipping office responsible for delivering your product. They will assist you according to their established procedures.

(l) For all customers, if it happens that you have not received your product at the same time as agreed from Oday Shop Tanzania, Oday Shop Tanzania will be responsible for providing true information as to why the product has not arrived on time and what immediate steps have been taken so that the product reaches the customer. Because there may be challenges from various sides such as transportation, financial services, industry, or directly at the Oday Shop Tanzania office.

15. Payment Options

(a) We accept Cash on delivery, Bank Payment, and Flutterwave with different Mobile Money payment options and Card.

(b) We offer Cash on Delivery in Dar es Salaam town areas, while in other regions, payment must be made before shipping.

16. Secure Ordering

(a) To protect your personal information, we take reasonable precautions and follow industry best practices to make sure it is not inappropriately lost, misused, accessed, disclosed, or destroyed.

(b) If you provide us with your credit card or other payment information, the information is encrypted using secure socket layer technology (SSL) and stored with AES-256 encryption.

(c) Electronic storage is 100% secure, we follow all PCI-DSS requirements and implement additional generally accepted industry standards.

(d) All electronic payments are now secured by Flutterwave.

17. Your Order Cancellation Rights

(a) You are entitled to cancel your order within 24 hours without giving any reason for doing so.

(b) In order to exercise your right of cancellation, you must inform us of your decision by canceling your order on the website by using our email address: Info@odayshoptanzania.com or WhatsApp/Call +255718625629

(c) We cannot cancel your order if it has already been shipped from Dar es Salaam to other regions.

(d) For customers in Dar es Salaam and outside Dar es Salaam, We cannot cancel your order as we have already issued the Electronic Fiscal Device (EFD) receipt and the product is exact product you ordered.

(e) For customers in Dar es Salaam and outside Dar es Salaam, If you receive a product that is different from what you saw on the website, App or WhatsApp or if the product is not new, you may cancel the order without paying any shipping costs or request a new product that suits your needs— the choice is yours.

(f)For customers in Dar es Salaam, If you receive the exact product you ordered, with the same appearance as shown in the picture, along with a handwritten receipt and a one-year warranty card, and you wish to cancel your order, you will be required to pay a shipping fee of 10,000 TZS for a distance from 8 kilometers onwards, from the office of Oday Shop Tanzania Tabata Bima, Dar es Salaam to where the customer is. For a distance of less than 8 kilometers, that is, from 7 kilometers and below, you will pay 5,000 TZS

18. Warranties

(a) We offer a warranty card for our products and services, but the warranty does not apply to every product or service.

(b) Some of our products from Oday Shop Tanzania and service are not warranted.

(c) We offer a one-year warranty if the product is damaged without the customer’s fault.

(d) If the product is damaged without the customer’s fault, you need to return it to the Oday Shop Tanzania office as long as it’s still within the one-year warranty.

18(a) Warranty is not applicable if:

  1. Repairs have been attempted by unauthorized persons.
  2. The original structure or functionality of the product has been altered.
  3. Modifications have been made to accommodate internal voltage requirements or other safety or technical standards.
  4. The transport receipt confirms your item’s shipment with detailing delivery date, carrier, and tracking information or Warranty card from Oday Shop Tanzania or Purchased Electronic Fiscal Device (EFD) receipt has been damaged or lost.
  5. Serial number / Model Number has been damaged or removed.
  6. The product is not used according to intended purposes, e.g. for domestic or commercial use.

19. Returns Policy

(a) To return your product, you should mail your product to the office of Oday Shop Tanzania.

(b) For customers outside Dar es Salaam, you must ship the product from your region using a transportation service to the Oday Shop Tanzania office in Dar es Salaam.

(c)For customers within Dar es Salaam, you are required to bring the product yourself or send someone to deliver it to the Oday Shop Tanzania office.

(d) You will be responsible for paying for your own shipping costs for returning your item. Shipping costs are non-refundable.

(e) If you receive a refund, the cost of return shipping will be deducted from your refund.

(f) Depending on where you live, the time it may take for your exchanged product to reach you may vary.

(g) Once your return is received and inspected, we will contact you using your provided contact information to notify you that we have received your returned item.

(h) We will also notify you of the approval or rejection of your return after processed.

(i) For a product received with manufacturing defects or damage during shipping, the product must be returned to Oday shop Tanzania within four (4) days of purchase. After four (4) days to pass, no more replacement can be requested for product defects.

(j) For a product received with manufacturing defects or damage during shipping, your return items will be processed within 2 working days after we receive your product with defects. After processing, shipping typically takes an additional 2-3 working days.

(k) To request a replacement for products within a one-year warranty, for a product that has already been used for more than four (4) days, the product must be returned within one year of purchased. After one year to pass, no more replacement can be requested for product damaged.

(l) For products within a one-year warranty that have already been used for more than four (4) days, Your return items will be processed within six (6) working days after we receive your product with damage. After processing, shipping typically takes an additional 1-3 working days depending on your location.

20. Late or Missing Refunds

(a) If you haven’t received a refund yet, first check your bank account again.

(b) Then contact your credit card company, it may take some time before your refund is officially posted.

(c) Next contact your bank. There is often some processing time before a refund is posted.

(d) If you’ve done all of this and you still have not received your refund yet, please contact us at Info@odayshoptanzania.com.

21. Request for product replacement

(a) To request a replacement for products within a one-year warranty, buyers are required to provide the following necessary details as proof:

  1. Photographic evidence of the product manufacturing defects,
  2. Video shows the problems,
  3. The transport receipt confirms your item’s shipment with detailing delivery date, carrier, and tracking information or Warranty card from Oday Shop Tanzania or Purchased Electronic Fiscal Device (EFD) receipt for proof.
